Yes, we are all with you on this. In fact I posted that idea two weeks ago and then saw Larry Tribe endorse it so we are all in good company. The Pres is afraid of court challanges, but he has a duty to oversee the spending that congress appropriated! Furthermore, if the court, any court rules against it, he has a duty to IGNORE THEM AS IRRELEVANT to his responsibility. As always, thanks for giving this a wider distribution! Thank you very much for explaining the 14th Amendment in such great detail. I’m tired of waking up at 2:30 in the morning worried about my 401K, Social Security, and being able to continue to live in this country. Biden has dawdled too long. It’s a waste of time to try to negotiate with imbeciles like McCarthy (who probably cheated his way through Cal State Bakersfield) and McConnell (who is just so lacking in a soul and full of disdain for regular people). There are many important issues before our country. To delay is naive.

Hm. There is legal precedent (not that SCOTUS cares anymore) in Perry v US. SCOTUS opinion then?

“Congress is WITHOUT power to abrogate the obligations of the United States in an attempt to lessen government expenditures.” There ye have it.

And this isn’t even a “who is equal” or “what is privacy” challenge. It’s in the Constitution.

Perry as you know is the only Supreme Court decision to examine Sect 4 - it does have some good language in it that helps Biden.

You mentioned Equal Protection ealier, thought I would see your take on this.

From the Cornell Law website "equal protection"

Overview

Equal Protection refers to the idea that a governmental body may not deny people equal protection of its governing laws. The governing body state must treat an individual in the same manner as others in similar conditions and circumstances. in the same manner as others in similar conditions and circumstances."

Would this not mean protections girls have from religious, cultural and non therapeutic genital cutting also mean boys and intersex children should be protected.

Also interesting while waiting to talk to you I was hung up on with over an hour left of your show.
