Trump should have been arrested on January 21, 2021 and held pending trial. We knew then, everyone knew then, that he was guilty of everything from obstruction of justice to sedition. There is no reason other than cowardice that he still roams free.

Exactly, and Garland‘s fear of appearing to be partisan has been key to leading us down this road where we live in fear of losing our democracy. There is no reason why the DOJ could not have been rounding up and prosecuting the January 6 mob members as well as the higher level planners and instigators simultaneously. In my humble opinion, Garland has been a disastrous AG, and probably would’ve been a much better judge. Now we are dealing with endless delays and the partisan Aileen Cannon, who is a disgrace among judges. For the life of me, I do not know why Jack Smith has not filed some kind of complaint against her. An attorney, who was posting comments on another site, indicated that Smith has plenty of ammunition to get her removed from this classified documents case. Our last great hope is that the Supreme Court does the right thing with regard to the Colorado disqualification case. Obviously, I’m not holding my breath.

Yes, every single one of those 147 traitors who would not certify the election results for certain states will probably never be held accountable, including my sleazy and useless rep, Lauren Boebert. Gratefully, she’s moving to another district, where she will also inevitably disgrace herself. Even if they would just hold the worst of them accountable – those who participated in the planning and execution of January 6, such as Jim Jordan – I would feel better.

I agree with all of what you say. My guess on Jack Smith and Loose Cannon is that he is waiting for an error so egregious that the 11th circuit has not choice but to remove her. Anything less that a massive violation of procedure or ethics would trigger Trump, the MAGAs, the right wing propagandists and, because they can't help themselves, the corporate media into a frenzy of charges of political prosecution, hate on Trump and all of the lies with which we have become so familiar.

Her plan to hold separate hearings for the prosecution and the defense over discovery of classified materials may just be that trigger. She's obviously doing it so that she can agree with Trump's lawyers who will have gone unchallenged in their bullshit.

Thank you for the outstanding comment. I'm fairly new to this stack. First time commenting, however the articles I've read (including this one) have been a joy to read and I appreciate the legal system analysis, but also the deeper meaning behind many of the bizarre and brazenly corrupt failures of both our criminal justice system and the legitimate media providers, including all sources of general public information/entertainment/narrative creation and maintenance.

The problem seems primarily rooted in the weaponization of Disinformation, Misinformation and particularly malignant and malicious Malinformation, by a vast network of extreme far right dark money groups and financiers. Many of these sources of funding are known by our intelligence services to be heavily backed by russian state actors, and indeed even directly from the vast personal wealth of corrupt, authoritarian psychopath and mass murdering dictater putin.

The point is that America is in extreme danger. Democracy itself, not only here, in the United States of America, but globally. I, like all normal, decent people living in this country, understand how and why this dumpster fire rages on. Twice impeached, insurrectionist leader, pathological LIAR, rapist CONspiracy theory spewing CONman, deranged and delusional criminal trump and his putrid, despicable, hateful, racist, facsist and increasingly detached from reality cult is what divides us. First they denied the election, then they made a mockery of the pandemic, refusing to believe in science just as with is the case regarding the Climate Crisis as well.

On every single important issue, the MAGAt cult, led by a proven LIAR and rapist, done dumpo, rejects solutions, and attacks President Biden as if he were the problem.

It's pathetic.

Thank you again for saying what the MSM can only tip toe around. I wish we'd all stop calling it the "Jan. 6 indictment," though. It's not. There are no federal charges in any indictment against tRump for inciting the violent attack on Congress on January 6, period. It's a "Fake Electors" indictment. (I know it sounds less sexy, but that's because it is). And the charges in the Fake Elector indictment as well as the charges in the Theft of Nuclear Secrets Indictment were carefully selected NOT to include mandatory jail time. Smtih could've chosen the very next statute down in Title 18 for a statute requiring the same acts and proof but carrying mandatory jail time. Nope, the lesser violation with optional jail time.....straight down the line. Jack and Merrick couldn't telegraph more their (lack of) intentions regarding jailing a sitting President. They are doing everything in their power not to.

And while I have your attention, in other election woes, I would like to disseminate the fact that if states would be made to award their electors in direct proportion to the state vote (win 60% of state vote, get 60% of electors) instead of anti-democratic "winner-take-all" (win 60% of vote get 100% of electors and FU to the losing candidate voters you get zero representation in the Electoral College ahahahahaha!!!!), as the States are presently free to do (see Maine and Nebraska) with no Constitutional amendment required (just a well-aimed lawsuit), the Electoral College would always match the popular vote. Gore woulda won. Hillary woulda won. K thanks bye.

The continued loss of faith in our justice system is not good for this or any country. Totally agree, Dean. But another important question is why, even now, hasn't Garland done anything about the congresspeople and senators who also contributed to this insurrection? From MTG to Ron Johnson, to Barry Loudermilk who led a tour of the Capitol complex on the eve of the riot. They are all complicit.

Totally agree! Merrick Garland blew it big time!! Why??? FEAR!!!! FEAR of appearing partisan … FEAR of the response of the MAGA Cult … FEAR of fracturing the political landscape even further when it was already broken and way beyond repair! Merrick Garland should be impeached for dereliction of duty … NOT Homeland Security Secretary Mayorkas. This lack of movement by the DOJ also shows, on the one hand, the FEAR in the Biden Administration about holding DT accountable for insurrection … but on the other hand it clearly shows that Biden throughout his presidency has allowed the DOJ to be independent (as designed to be) and never saw it (as DT) as his personal fiefdom to exact his anger and retribution. If the 14th Amendment case fails in the SC (which I expect) then the American voters are going to have to save our Constitutional Republic once again as they did on Nov. 3, 2020. God help us! Merrick Garland sure hasn’t! 😚

I've heard some experts state that from day one Garland could have launched an investigation based upon what the Mueller report contained. Not wanting to be seen as 'political' is a farce, a big one. The common ordinary decent citizens demand justice and prosecution of criminals that wear suits, and maybe even robes. The loss of faith is demoralizing.

As to the "not wanting to look political" idea: In a way it doesn't matter to Trump: he unconditionally labels EVERYTHING, every obstacle, that he encounters as being political anyway. There's no escaping that.

History will not be kind to Merrick Garland. His interminable delays and foot-dragging have contributed heavily to a major delay in seeing justice done. Garland has been, by far, the biggest disappointment of all of Biden's appointees. And if Trump should somehow cheat his way into the White House (again) and turns the U.S. into his private authoritarian fiefdom, I will hold Garland responsible to a significant degree. Shame on you, Merrick Garland. Shame on you.

Great article Dean. So many people are wondering why this has gone on so long. I have never believed that MG was up to the job. He’s a judge, not a prosecutor, doesn’t have the (killer) instinct. By not wanting to appear partisan, he became partisan. It has been like he has been shying away from anything-tRump from the beginning. He was clueless in understanding that no matter what he did, he would still forever be linked to tRump. He was so well regarded before becoming AG, but as they say… everything tRump touches dies, and in this case what has died is his reputation.

Disqualifying him would make is easier to prosecute him. If he is disqualified, his donors could sue him for fraud. He knew or should have known his acts disqualified him. After all, he took an oath as the defender of the Constitution.
