Excellent post and I totally agree! He orchestrated and attempted a coup - what else is “staying in power despite losing” if not an attempted coup? He should be charged for this. And this is treason.

I tuned in yesterday and was heartbroken you weren’t on! Hope you’re feeling better and can’t wait to hear your first show back. Ironically one of the victims in all this was Mike Pence. Along of course with the voters. Jack Smith is a rock star. As was the Jan 6 committee. These trials need to be televised. It’s treason. We need charges in Georgia. He won’t be able to weasel out of state charges.

There are zero new charges in this indictment over the last, just different fact patterns. Short of filing treason charges which carry the death penalty*, there are various statutes open to Jack for document violations(18 USC 2170, for but one) and insurrection (to start let's just say 18 USC 2385) that don't require any further evidence outside whats specified in the indictments, but which carry the ADDITIONAL penalty of temporary or permanent disqualification from holding any office. There are many such statutes. Jack avoided them all. Purposefully. Thus, Jack/Merrick have de facto repealed the 14th Amendment and violated their oath to protect the Constitution from an insurrectionist seeking office and a repeat performance. If tRump were convicted for the unused charges, particularly for an insurrection charge with such penalty, then any successor couldn't pardon him without legally being an insurrectionist by default. Now they can. *No one obviously will pursue a death penalty charge since they've been afraid to even arrest him for this long. I have unqualified doubts that Loose Cannon or this new judge will jail a former president either, which isn't a required sentence for any of the standing charges. So tRump will just be fined for everything to date. His dupes will pay the bill for him and he will continue to golf and spread antidemocracy a free man while the next tRump does a better job burning down the Republic. All due to DoJ 's complete and utter failure and malfeasance. The end.

Me too. I really do. I am not an alarmist. But I am an attorney with enough experience to follow developments in fine detail. In my professional opinion, I should quite happily accept any opposing bets.

Actually, your opinion/assessment of the situation is a good caution. I'm not a lawyer. Privately I do believe we are not out of the woods by a long shot. I won't be surprised if Trump and chronies are treated lightly --if in fact any are actually convicted. I was a young adult during Watergate and I think I'm a fairly good judge of character. Despite the hard work of many patriotic Americans, our institutions may not recover from 40+ years of protofascist GOP assaults. I hope I'm wrong. I think our National Goose may be cooked.

Consider that Reality Winner was jailed for 5 years within months of discovery on charges that disqualify her from running for office....for taking a single two-page non-top secret document that contained proof tRump colluded with Russia, and sending it to The Intercept in response to a reward offer for anyone providing proof of Russian interference. Hard to put that on "the Left." Extremely easy to put it all 100% entirely on DoJ and its right wing leanings that have been institutionalized since its inception. Hell, the FBI building is named for the most famous right wing prosecutor of the left of all time, J. Edgar Hoover, who is indeed quite the role model.....for them.

I'm making the argument first and foremost that what Trump did was Treason in the common sense definition of it. The legal definition is so narrow I understand why Jack Smith didn't seek to charge him with Treason. But apart from US legal definition, Trump engaged in treason.
