Now that President Biden is a King, he should arrest the 6 justices that made this decision, put them in prison as a threat to our country, and immediately replace them. Thanks to their decision, we do not need to wait to reform SCOTUS.

Expand full comment

In all seriousness, he could technically deem the treasonous 6 as a dire threat to democracy, and use the total immunity clause to remove them!

Biden and all Democrats need to make SCOTUS Reform a major plank in their platform.

Expand full comment

Actually, something far greater than reform is needed. The SCOTUS along with the lower courts

(both federal and state) are vested with the responsibility to keep prosecutors from going rogue. Time and time again the prosecutors have intentionally violated the publicity rules of

conduct knowing that all these justice officials would underwrite it instead of disciplining them for it. This has happened now in the four prosecutions against Defendant Trump. It's nothing new. This type of corruption has been approved by the SCOTUS and the rest for the last 61 years.

Spot On, Dean !!! Biden needs a Blue House and Senate next term. Then ,and only then, Congress must hit the floor Running. Pack the court and pass Laws to prevent anything like what we've seen from the last administrations judges. Also, over turn the rulings on the Chevron desison so Americans can have clean water and air. Make ROE a Law, give women charge over their own bodies.Never in my lifetime have I seen such a poison to our way of life as the likes of" Donald"and his henchmen! Again, Dean, thanks 🙏

I think it's a better idea to balance the court between democrats, independents and republicans. That is the least alienating solution to what the court is now, and I think it should be enshrined in law. I also very much want to see at least Alito and Thomas impeached and removed.

Expand full comment

Balance? The current Supreme Court is NOT split between democrats and republicans. The split is between the 3 who support the Constitution and uphold the democratic ideals of America, versus the 6 radical extremists who seek to eviscerate America as nation of laws, and replace it with a nation ruled by their own hand-selected fascist dictators.

Expand full comment

I agree completely. I would want to see the radical extremists replaced with people who are moderate, who know, understand, and respect the law and precedent, and who understand the importance and place of the constitution in our country.

Yes, we must at least get rid of the Thomas the bribe taker who sells his ruling to the highest bidder and Alito who would rule anyway the wealthy benefactor wants him to for a good paid for fishing trip. But Gorsuch and Kavanaugh must also be deposed. They lied at their nomination hearings, so they are dishonest and have no place on the highest court in the land.

Excellent point and clarification of what the justices stand for.

Expand full comment

Len, I think that balance is what we used to have before the right to to be so extremist. Anyone who is independent may lean right on some issues, and left on others. I will point out that Justice Roberts is the one who upheld the validity of the ACA. I think the point is to achieve a level of sanity for SCOTUS.

Expand full comment

Republicans? Or Trumplicans? That kind of balance? Why not liberals, conservatives, and moderates?

Point taken. That's what I meant by my comment.

The Supreme Court has become the unelected nightmare that the GOP complained about when the liberal Warren and Burger Court made decisions like Brown, Miranda, Gideon, and Loving as well as Roe v Wade, US v Nixon and Gregg v Georgia. Now they are doing the exact same thing in its decisions that are a only a minority of Americans agree with. It should make historians and political observers strongly question whether the conservative legal movement was authentic beliefs or really just an engine for astroturfing, donor plutocracy built out of fearmongering and gaslighting, and a way to bring back a Gilded Age America that wealthy benefactors had been fighting for since the days of the New Deal.

And Burger was no flaming liberal. 🤔😉😊

Exactly, but compared to today…whew!

Dean, can Supremacist Court Justices be impeached or removed by any process? Why does our side always follow the rules and those who destroy democracy disregard them altogether?

Expand full comment
author

Yes they can. AOC has announced she will introduce articles of impeachment when Congress returns but since GOP controls the House it won't go anywhere

Expand full comment

Thank you, yes...I've noticed that and will do what I can to support AOC's efforts.

Expand full comment

But like Dean stated, the GOP controls the house, which make it imperative that we take the house, keep and add to our senate majority and hopefully take the Executive branch as well. The house and senate though are extremely important to vote for democratic majorities.

Expand full comment

Yes, they can be impeached, and if convicted, removed. It’s essentially the same process as impeaching and removing a President. Samuel Chase was impeached in the early 1800s but not convicted. More recently, a Federal District Judge named Alcee Hastings was impeached and removed in ‘88-‘89 for bribery. Impeachment is impossible with the current House, and conviction would, I think, be unlikely (unfortunately ) in any case since you need 2/3 of the Senate. 🤔😉😊

Thank you, Jeff...this is disturbing and disheartening.

Ditto. I’m feeling as depressed as I’ve felt in like a year. And a year ago I was suicidal. 🤔😉😊

Expand full comment

Don't be suicidal, be angry! We need all of our fighters for democracy that we can muster. We've fought a Revolutionary war before to rid ourselves of British rule and subjects of a King. We prevailed and became the most power full and greatest country on earth. The Supreme Court 6 fucks has now bestowed King status on the convicted felon and sextual abuser and stealer of over 100 boxes of classified documents ( what do you think he was going to do with them?). I prefer to be a citizen of the Great USA, NOT a subject of a King

Oh, gosh,...I hope that the threat from the sociopathic MAGAs, is energizing democracy-defenders and that it will give people like us some much-needed reason to work and to hope.

Thank you. The last few days have been rough, but my keel’s been pretty even lately. I'll be OK, I have a support system that I didn’t have last year. I appreciate the concern, and please allow me to reflect it back. The ad hoc mini-conversations I’ve had, here and elsewhere since Friday, have really helped. 🤔😉😊

Thanks, Jeff...I feel the same. :-)

It’s absolutely essential to reform the Supreme Court. As Dean pointed out, the Roberts court, dating back to Citizens United, has put the interests of ideologues and oligarchs above the rights of average people. It is time to legislate real ethical and legal accountability for all Federal courts, but particularly SCOTUS. Lifetime appointments need to be eliminated. Decisions pulled out of thin air, such as the Immunity ruling must be overturned.

Expand full comment

I disagree regarding “balancing” the court If you mean drawing from the MAGA right. There is no compromise between democracy and fascism. Now if you are referring to mainstream conservative viewpoints which still prioritize democracy (George Conway, Liz Cheney, Adam Kinzinger et al, then yes that could work.

Expand full comment

And, lest we forget to worry about the economy, which could sink us all even deeper than any supreme court decision. The next great depression might be within the year of the start of a Trump presidency. As we name hurricanes, the next "recession" will have a name. Trump's Revenge. No one will remain unscathed... at any economic level. Except Trump and his backup singers.

I’m sure you meant rogue. They should be rouge (red) but I don’t think they’re capable of embarrassment.

James, I was going to point that out as well. ;) I immediately envisioned Alito and Thomas applying rouge on their cheeks. Lol!

That rouge would more appropriately adorn their countenances, as their personalities and ethics reflect; 🤡 clowns.

We've been the humanitarian, nice guys long enough! President Biden ought to take his newly anointed kingship out for a spin! He could justify his moves as dire (underlined) threats to democracy utilizing total immunity! Let's show these fascists when pushed too far, "snowflakes" can kick some serious ass! It's all justifiable now, right?

Congress has the power to oversee SCOTUS. Why don't they use it?

Time for Biden to wake up and get over his institutionalism. If he wins, holds the Senate, (I think we’ll flip the house), then fixing this out of touch, imperial court MUST be a priority. 1st-Get rid of the filibuster.

2nd-Add 4 seats, limit terms and write some REAL ethics rules.

If Biden doesn’t do anything, we will witness the destruction of not only our administrative state (EPA, FDA, FIC, etc will be stripped entirely of their power, but of our democracy.

Enough already.

Flipping do something about this corrupted, fanatical, lying, radical court.

I would also add, Michael that right wing fascist movements are also motivated by unconscious envy, resentment, and spite. "Strongmen" rely on arousing these feelings in unaware followers, diabolically controlling their minds through propaganda , and steering their behavior in the direction that satisfies the "strongman's" grandiose fantasies of supreme power.

Biden and Garland are WEAK. We need a real leader dedicated to reform. Jamie Raskin comes to mind. There are others as well. There is no time to waste. Read the polls. A fearless democrat will garner ALL democratic votes plus Independents and traditional Republicans. Enough gaslighting. Biden is not strong enough for the make or break democracy issues. We need a fighter, not an old man who is still looking for his kumbaya moment with MAGA.

We have what we have. We fight with what we have or we lose just lamenting about what we have.

I completely agree with this perspective, Marjorie. We need a fearless and inspiring candidate who will arouse the half asleep masses and hopefully overwhelm the Magas at the ballot box… If we're lucky enough to safely get to an election, that is.
