I think if Dems frame this as rebalancing the courts instead of packing then they might get a lot of support. Recent corruption and judgements from the court definitely help make that case as well. And I think that’s a framing that Biden should be able to get behind. Hopefully.
Oh, 100% they’ll push the narrative back to packing but I think if we can force the conversation to happen in the frame of fixing / rebalancing then the people who get nervous about the term ‘packing’ can get behind the idea. Beat the corruption in the SC drum and fundamentalist ideology that’s holding the nation hostage and keep the focus on that. Not saying it will work but maybe try to keep the light on the issue of not fixing the court and stay on that message.
The Court should have been expanded when Dems had control but Biden refused to get behind the idea. There is no way the MAGA House will allow it, and frankly, in the unlikely event that Garland appoints a special counsel to investigate the thoroughly corrupt Clarence Thomas, Gym Jordan and the rest of his co-conspirators will immediately go after that counsel. Net result, Thomas is not going anywhere until Thomas decides he's ready to go.
What Garland could, and should do, is go have a private chat with Clarence and offer him, and Ginni, a pass if he retires.
Garland going to discuss issues with Thomas without the threat of a full legal investigation into Clarence and Ginni's potential crimes, including how they reported their donor income taxwise would fail. However, to the extent Garland made his threat credible, they would run for the hills rather than face examination.

If Garland could get THomas to retire that would be huge - we could get to a 5-4 court on our way to control down the line.
