We defended democracy —it’s now Time for Justice!!
In last week’s of The Dean’s Report, I laid out the stakes of this past Tuesday’s election and that was to save our democracy! It was a message that Presidents Biden and Obama also made in the last few weeks of the campaign. And we, the people, did just that. By coming out big, we crushed any chance of a red wave.
Consequently, we won the U.S. Senate by defeating Donald Trump’s hand-picked candidates Dr. Oz in Pennsylvania and Blake Masters in Arizona. Very importantly for our democracy, Democrats came out big to win the governor races in the battleground states of Michigan, Pennsylvania and Wisconsin. In fact, we won those three races by far more in 2022 than Joe Biden did in 2020.
And perhaps the most important development was that voters defeated every one of Trump’s democracy denying Secretary of state candidates in the battleground states. That includes two of the worst democracy deniers out there: Mark Finchem in Arizona—who is part of the Oath Keepers—and Jim Marchant in Nevada who had vowed if he won to ensure Trump won the state in 2024.
The result is that Trump and MAGA GOP’s efforts to literally rig the 2024 election has been thwarted—at least for now. But we did our part.
Now it’s time for Attorney General Merrick Garland to do his. And that of course means indicting Trump for his crimes.
It has been over 670 days since Trump’s Jan 6 terrorist attack on our Capitol designed to prevent the peaceful transfer of power. On that day, Trump refused to call off his attackers for over three hours despite pleas by many including his own daughter.
Apart from the attack, Trump was engaged in a behind the scenes coup attempt. As federal judge David Carter wrote in an opinion in March, his review of Trump’s actions has “more likely than not” committed two felonies: 1. Obstruct the Joint Session of Congress on January 6, 2021 and 2. Defraud the United States of America with the false elector scheme, etc. FYI “More likely than not” is a higher standard than needed to obtain in indictment.
Then there are crimes in connection with Trump’s illegal taking and possession of governmental records. This article by lawfareblog.com lays out the potential crimes committed by Trump from obstruction of justice to Retaining National Defense Information, 18 U.S.C. § 793(e).
Indicting, prosecuting and convicting Trump is vitally important to protecting our democracy.
As historian and authoritarian expert Ruth Ben-Ghiat explained in a 2021 interview, Trump is “an authoritarian leader” who has--like other autocrats- developed a “cult” like following. Ben-Ghiat continued, Trump has “followed the authoritarian playbook with propaganda, with corruption, with incitements to violence.”
This makes Trump’s bond with his supporters unlike anything we are accustomed to seeing in American politics. To that very point, Ben-Ghiat—in an article she penned last year in The Economist—explained that Trump’s “influence will not dissipate until the institutions of democracy formally confirm misconduct, for example with a court conviction.” That is why in her view “it is so important to hold Mr. Trump accountable.”
Of course, we don’t know how an indictment would impact Trump’s supporters. It may make them cling to Trump even more tightly. But regardless of the political impact, indicting and convicting Trump is key to deter others from others in the future—including Trump—from committing these same crimes.
Mary Trump was on my SiriusXM show earlier this week where she made news calling on Garland to indict her Uncle Donald before he announces his presidential run—which may happen this week. I agree with her 100 percent! (You can watch entire interview below.)
We did our part to save democracy, it's long past time that Merrick Garland do his by indicting Donald Trump!
